Terms of Service

By registering for or using Think Pink Connections ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

To use Think Pink Connections, you must meet all of the following requirements:

• You must be at least 18 years of age
• You must be an active or prospective Mary Kay Independent Beauty Consultant
• You must have a valid Mary Kay Consultant ID
• Your account must be approved by Think Pink Connections before you can access the Service

Think Pink Connections provides a software-as-a-service (SaaS) SMS marketing platform that enables Mary Kay Independent Beauty Consultants to:

• Manage customer contact lists
• Send individual and bulk SMS messages to their customers
• Create and use preset message templates
• Track message delivery and usage statistics

The Service uses Twilio for SMS delivery and Stripe for subscription billing.

Think Pink Connections offers the following subscription tiers. All plans include the same features — only the monthly credit allowance differs:

Subscriptions are billed monthly. Overage charges of $0.03 per message apply when your monthly credit allowance is exceeded. Billing is processed securely through Stripe. We do not store your payment card information.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

You agree to use Think Pink Connections only for lawful purposes. You may NOT use the Service to:

• Send messages to contacts who have not provided consent to receive SMS communications
• Send spam, unsolicited messages, or messages unrelated to your Mary Kay business
• Harass, threaten, or abuse any person
• Send any content that is illegal, obscene, or harmful
• Violate the Telephone Consumer Protection Act (TCPA) or CTIA guidelines
• Use the platform for any purpose other than Mary Kay business communications
• Share your account credentials with any other person
• Attempt to reverse engineer or hack the platform

By using Think Pink Connections, you agree to:

• Only send messages to contacts who have given express consent to receive SMS communications from you
• Include "Reply STOP to unsubscribe" in all marketing messages
• Honor all opt-out requests immediately
• Comply with the Telephone Consumer Protection Act (TCPA)
• Comply with CTIA Messaging Principles and Best Practices
• Not send messages to contacts on the National Do Not Call Registry without prior express written consent

Think Pink Connections automatically processes the following keywords in compliance with carrier requirements:

All new accounts require manual approval by Think Pink Connections before access is granted. We reserve the right to:

• Decline any registration without explanation
• Suspend or terminate accounts that violate these Terms
• Suspend accounts for non-payment
• Suspend accounts at the request of Twilio or applicable regulatory authorities

The Think Pink Connections platform, including its software, design, logos, and content, is owned by Think Pink Connections, LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

SMS delivery is subject to carrier availability and Twilio's service terms. We are not responsible for messages that fail to deliver due to carrier issues, invalid phone numbers, or recipient opt-outs.

To the maximum extent permitted by law, Think Pink Connections, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, lost data, or business interruption.

You agree to indemnify and hold harmless Think Pink Connections, LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or third-party rights

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the courts of Leon County, Florida.

We reserve the right to modify these Terms at any time. We will notify registered users of significant changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
